These terms and conditions of use (“Terms of Use”) govern your use of all online interfaces and properties, including websites and mobile applications, owned and controlled by BodyFactory (collectively, the “Site”), as well as the services (“Services”) made available through the Site.
BodyFactory (“BodyFactory,” “we,” “us,” and “our”) provides non-clinical, administrative, marketing, technology, and business support services. BodyFactory contracts with Aura of Vitality NP in Family Health, P.C., a New York professional service corporation (the “PC”), to support the delivery of professional medical services by licensed healthcare professionals (individually, a “Provider” and collectively, the “Providers”) to their patients.
The professional medical services provided by the PC and the non-clinical Site services provided by BodyFactory are collectively referred to as the “Services.”
The terms “you” and “your” mean you, your dependents if any, and any other person accessing your BodyFactory account.
You affirm that you are at least eighteen (18) years of age and are legally capable of entering into this Agreement. By accessing or using the Site or Services, you agree to be bound by these Terms without limitation or qualification. If you do not agree, do not use the Site or Services and exit immediately.
All disputes between you and BodyFactory or the PC relating in any way to these Terms or the Services shall be resolved by binding arbitration on an individual basis. You waive the right to a jury trial and to participate in any class or representative action.
Information you provide in connection with the Site and non-clinical Services is governed by the BodyFactory Privacy Policy. Information provided in connection with clinical Services is governed by the Notice of Privacy Practices of Aura of Vitality NP in Family Health, P.C., in accordance with HIPAA and applicable New York law.
BodyFactory does not provide medical care or medical advice. All medical services are provided solely by Aura of Vitality NP in Family Health, P.C. through licensed Providers. No provider–patient relationship is created by use of the Site alone.
You must be at least 18 years old and provide complete and accurate medical information. Failure to do so may result in refusal of treatment or cancellation without refund.
Payment is due as disclosed at booking or at the time of service. BodyFactory does not accept insurance unless expressly stated. Appointments must be cancelled at least 24 hours in advance. No refunds are provided for services rendered.
You are responsible for following all post-treatment instructions. Failure to do so releases BodyFactory and the PC from liability.
To the maximum extent permitted by law, BodyFactory and the PC shall not be liable for indirect, incidental, or consequential damages. Liability is limited to the amount paid for the specific service.
You agree to indemnify and hold harmless BodyFactory, the PC, Providers, and affiliates from claims arising from your use of the Services or violation of these Terms.
By using the Services, you consent to receive communications electronically, including SMS messages. Message and data rates may apply. You may opt out by replying STOP.
BodyFactory may suspend or terminate access for violations, security concerns, or legal compliance.
These Terms are governed by the laws of the State of New York. Arbitration shall take place in New York, NY.
